Terms of Service.

These Terms of Service (“Terms”) govern your access to and use of yamumedia.com (the “Site”) and any related services provided by YAMU Media (“YAMU,” “we,” “us,” or “our”). By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1. The Site
The Site is an informational and lead-qualification platform for YAMU’s performance marketing services. It is not a transactional platform — engagements are formed under a separate written agreement after application and acceptance.
2. Eligibility
You must be at least 18 years old and authorized to act on behalf of any business you represent when using the Site. By submitting an application, you confirm that the information you provide is accurate and that you have authority to enter into discussions on behalf of your company.
3. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any law.
- Submit false, misleading, or fraudulent information through any form on the Site.
- Attempt to interfere with, probe, scan, or test the vulnerability of the Site or any associated systems.
- Use the Site to harvest data, scrape content, or build a competing dataset.
- Impersonate any person or misrepresent your affiliation with a person or entity.
- Reverse engineer, decompile, or otherwise attempt to derive source code from the Site.
4. Submissions
Anything you submit through the Site (application answers, messages, comments, ideas, feedback) is voluntary and non-confidential. You grant YAMU a non-exclusive, royalty-free, worldwide license to use, store, reproduce, and act on your submission for the purpose of evaluating fit, responding to you, and operating our business.
You confirm that any submission is your own or that you have the right to share it, and that it does not violate any third party right.
5. Intellectual property
The Site and all of its content — including text, design, graphics, logos, photos, written analysis, the YAMU name and marks, and any underlying software — are owned by YAMU or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and view the Site for your personal or internal business use. You may not copy, redistribute, republish, scrape, or create derivative works from any part of the Site without our prior written consent.
Quoting short passages with attribution and a link back is permitted under standard fair-use conventions.
6. Third-party links and services
The Site may link to third-party websites or embed third-party services (for example, Calendly for scheduling, GoFundMe for foundation donations). We do not control and are not responsible for third-party content, services, privacy practices, or terms. Your use of any third-party site or service is subject to the terms of that third party.
7. No advice
Content on the Site — including articles, the journal, frameworks, and analysis — is provided for informational purposes only. It does not constitute legal, financial, accounting, tax, or regulatory advice. Decisions you make based on Site content are your own. Engage a qualified professional before acting on anything that could affect your business.
8. No engagement until written agreement
Submitting the application form, booking a call, exchanging emails, or any other contact through the Site does not create a client relationship or any contractual commitment from YAMU. A client relationship begins only when both parties sign a written services agreement.
9. Disclaimer of warranties
The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, YAMU disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any content is accurate, complete, or current.
10. Limitation of liability
To the maximum extent permitted by law, YAMU and its officers, directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Site or its content, whether based on contract, tort, statute, or any other legal theory, even if YAMU has been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or related to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations, so they may not apply to you in full.
11. Indemnification
You agree to defend, indemnify, and hold harmless YAMU and its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any content you submit through the Site.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
13. Changes to the Site and to these Terms
We may modify, suspend, or discontinue any part of the Site at any time, with or without notice. We may also update these Terms from time to time. The effective date at the top reflects the latest revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
14. Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and YAMU regarding the Site.
